New rules for opening private schools in Delhi have been notified following amendments to the Delhi School Education Rules, 1973, with the approval of Lieutenant Governor VK Saxena and prior approval from the Central Government.

Under the amended rules, the Administrator/LG will have the power to determine whether the opening of a proposed new school is in the public interest. The decision will be taken after considering the details submitted as part of the proposal, and an inquiry may also be ordered if required.

The provision, however, will not apply to schools proposed to be established on privately owned commercial land.

Essentiality Certificate For Government, Municipal Land

The amended rules also make an Essentiality Certificate mandatory for those seeking to acquire government or municipal institutional land for establishing a new school.

The certificate will have to be obtained before the land is purchased or allotted.

The change is intended to ensure that the requirement for a new school is assessed before government or municipal institutional land is acquired or allotted for the purpose.

As part of the amendments, clause (ii) of Rule 50 of the Delhi School Education Rules, 1973, has been deleted.

The existing Rule 50 deals with conditions for recognition of private schools. Among its provisions, it requires a recognised school to meet specified conditions relating to its management, infrastructure, facilities and other requirements.

The amended rules have been notified after obtaining the prior approval of the Central Government, bringing the changes into force for the process of establishing new private schools in Delhi.

The amendments come against the backdrop of the Delhi government’s ongoing efforts to modify the regulatory framework governing private schools and their recognition. The Directorate of Education has historically required applicants seeking to establish new schools to provide details including the proposed location, student capacity, existing schools in the area and other information for consideration.
